Welcome to GorillaLeak.com. If you continue to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Gorilla Leak's relationship with you in relation to this website.

IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MAY NOT ACCESS OR USE THE DIRECTORS LIVE SITE OR SERVICES AND SHOULD EXIT IMMEDIATELY.

1. ACCEPTANCE OF TERMS

The Gorilla Leak Website is operated by Directors Live, LLC. All references to Gorilla Leak also refer to Directors Live, LLC. These terms and conditions ("Terms") govern the use of the Gorilla Leak website (the "Website") and all related services provided by Gorilla Leak (the Website and related services are collectively referred to as the "Website") and constitute an agreement between you ("You") and Gorilla Leak ("Gorilla Leak"). Your use of the Website, including any new services or functionalities that may be made available by Gorilla Leak from time to time, is conditioned upon Your acceptance of and continued adherence to these Terms. Gorilla Leak reserves the right to alter or revise these Terms at any time by notifying you as provided in these Terms, provided that no notice shall be required for non-substantive changes to the Terms. If we substantively amend this Agreement, we will give you at least seven (7) days notice before the changes take effect, during which period of time you may reject the changes by terminating your account. Your continued use of the Website indicates Your acceptance of any and all revised Terms. Gorilla Leak reserves the right to suspend or terminate Your account at any time or discontinue Your access to the Website or remove your Posts for any reason.

2. DEFINITIONS AND SERVICE DESCRIPTION

  • "Contributor": A person that creates an account (video publisher, blogger, writer, expert, dj, author) on the Website.
  • " Content": Any content, including without limitation blog posts, post comments, that Authors post on the Website other than on the Contributor’s Posts, and all photographs that Authors post on the Website (including on the Contributor’s Posts).

Gorilla Leak makes available a Posts Tool (and other tools) to create Posts and for the Contributor to engage in Contributor Services. The Website hosts and serves the Posts, including the Posts Content, to users of the Website ("Users"). Gorilla Leak will program portions of the Posts created by Authors with information related to other Posts on the Website. Users can publish and submit blog posts to other social networking forums as may be permitted by the features and functions of the Website.

An editorial staff will monitor the Post. Content that are determined to be low quality will be removed from the Website.

3. PERMITTED USES

You must register with Gorilla Leak and create a Contributor account (including selecting a screen name/username and subdomain name for Your Account) in order to create a Post. Gorilla Leak, in its sole discretion and at any time, may change, remove, reclaim, and/or reassign the screen name/username and/or subdomain name associated with Your Contributor account (this potentially includes but is not limited to a trademark owner complaining about a screen name/username/subdomain name that does not closely resemble Your real name). Only adults (17 years and over) may register for an Contributor account. Your Contributor account gives You access to the services and functionality that we may establish and maintain from time to time and in our sole discretion. You are responsible for any and all activities occurring or content that is posted under Your account. If You discover any unauthorized activity under Your account, please alert Gorilla Leak immediately, by sending an email alert to info@GorillaLeak.com.

  • You must do Your best to create high quality Posts http://www.gorillaleak.com/tutorials/
  • You are solely responsible for the Content you post.
  • You must follow specific guidelines outlined here and in the tutorials for publishing forum posts, comments, questions and answers, and other content services that are posted on the Website.
  • You may only post Content to which You have the necessary rights, including (but not limited to) intellectual property rights regarding copyright, trademark, and trade secrets. This means, among other things, that You must have permission to use third party content from the content owners.

By giving us Your email address, You grant us permission to send communications from Gorilla Leak, such as account creation confirmations, service announcements, administrative messages, and any of the opt-in Gorilla Leak newsletters you select to that address. You may opt out of certain email communications from Gorilla Leak by following the instructions on the email. You may not opt out of Website-related messages. If You do not want to receive such messages from Gorilla Leak, you must cancel Your account.

4. RESTRICTIONS AND PROHIBITIONS ON USE

In Your use of the Website You must abide by the following restrictions and prohibitions on use. As a Website User or Contributor, You may Not:

  • Publish Posts or Contributor Content that include any content or links that are pornographic, defamatory, libelous, tortuous, vulgar, obscene, invasive of privacy, racially or ethnically objectionable, hateful, promotes or provides instructional information about illegal activities, promotes any act of cruelty to animals, or is otherwise offensive.
  • Publish Posts or Posts or Contributor Content targeted at children under the age of 13.
  • Use Gorilla Leak, the Website to violate any Federal, state or local laws. Your Posts must comply with all laws regarding online conduct and acceptable content.
  • Hack the Website or modify any Posts that are not Your own.
  • Link to any worms or viruses or any code of a destructive nature.
  • Link to pages or sites that are unrelated to the topic and content of Your Posts.
  • Remove, decompile, disassemble or reverse engineer any Gorilla Leak Software (as defined below) or use any network monitoring or discovery software to determine the Website architecture.
  • Publish Posts or Content in breach of a confidentiality or fiduciary obligation You may have.
  • Attempt to automatically redirect Website users to other domains, mislead users of the origins of the Posts Content contained in Your Posts, or use Your Posts as storage for remote loading or a door or signpost to a website outside of the Website.
  • Impersonate another person, Contributor, entity, or any representative or employee of Gorilla Leak (note that such may include the screen name/username/subdomain name that You select for Your Contributor account).
  • Disrupt the Gorilla Leak Website, or any servers by embedding code in the Posts or otherwise attacking the Website.
  • Publish Posts or Content for any illegal activities or to promote or make solicitations for any illegal or unauthorized activity.
  • Spam any User or mass email any User in an automated fashion.
  • Collect personal identifiable information about the Users of Your Posts and sell or transfer that information.
  • Use any automatic or manual process to harvest email addresses or other information from the Website.
  • Harass, threaten or intimidate Authors or others who use the Website.
  • Publish Posts or Content written primarily in a language other than English.
  • Promote gambling or links to sites that promote/offer gambling for money.
  • Display misleading tags, categorizations, and/or titles that don’t match the Posts’s content, including irrelevant or excessive tagging.
  • Engage in behavior that is overly promotional, including excessive linking to any one site or domain.
  • Spam to promote Posts or Profiles, including comment spam, forum spam, spam blogs, email spam, instant message spam, or similar.
  • Use automation tools to create Gorilla Leak Accounts, Posts, or Contributor Content, to follow topics or Authors, or to edit Posts. This includes, but is not limited to, article spinner software, blog and comment blasters, and similar software and online tools and services.
  • Publish Posts or Posts Content that are identical to, substantially similar to, or derived from other Posts and/or content published elsewhere on the Web. This applies even if You are the owner of that content and/or have the rights to publish that content online.

Each of Your screen name/username/subdomain names must comply fully with all Gorilla Leak content rules and restrictions.

5. DISCONTINUATION OR MODIFICATION OF THE SERVICE

Gorilla Leak reserves the right to modify or discontinue, temporarily or permanently, the Website or any portion thereof at any time, without liability to You or any third party. In addition, Gorilla Leak, in its sole discretion, may terminate Your password, account or use of or access to the Website (including Impression services as further described below), and remove and delete any Posts or Content, for any reason.

6. PROPRIETARY RIGHTS; CONTENT OWNERSHIP

The Website and any software used in connection with the Website ("Software") contain proprietary and confidential information that is protected by applicable intellectual property and other laws. Except as expressly authorized by Gorilla Leak or advertisers, You agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Website or the Software, in whole or in part. In addition, the content, organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to the Website are protected under applicable copyrights, trademarks and other proprietary (including, but not limited to, intellectual property) rights. The copying, redistribution, use or publication by You of any such matters or any part of the Website, except as expressly allowed herein or via distribution tools Gorilla Leak makes available to Users, such as RSS feeds and widgets, is strictly prohibited. Gorilla Leak may at any point make additional software and tools available to Authors in connection with the Website ("Additional Software"). Authors who incorporate such Additional Software into their Posts may have to agree to additional terms and conditions before using such software, and all rules and obligations outlined in these Terms apply to the ownership and use of such Additional Software.

Gorilla Leak does not claim ownership of Your Posts Content or Contributor Content. Such content will be owned by You or a third party from whom You got permission to post the content. By posting Posts Content on the Website, You grant Gorilla Leak a worldwide, royalty-free, and non-exclusive license, for as long as Your Post(s) is displayed on Gorilla Leak and for a commercially reasonable time thereafter, to reproduce, publicly display, publicly perform, distribute, modify, adapt and publish the Posts Content solely for the purpose of displaying, distributing and promoting Your Posts on or in connection with the Website. By posting Contributor Content on the Website, You grant Gorilla Leak a worldwide, royalty-free, non-exclusive, perpetual, irrevocable license to reproduce, publicly display, publicly perform, distribute, modify, adapt and publish the Contributor Content on or in connection with the Website. You may remove Your Posts Content from the Website at your discretion. You may not remove your Contributor Content from the Website. Gorilla Leak may preserve and store Posts Content (including, for a commercially reasonable time, Posts Content you have removed from the Website) or Contributor Content, and may disclose such content if required to do so by law or if Gorilla Leak believes in good faith that such preservation or disclosure is reasonably necessary to: (a) comply with legal process (e.g., subpoenas); (b) enforce these Terms; (c) respond to claims that any Posts or Content violates the rights of third parties; or (d) protect the rights, property, or personal safety of Gorilla Leak, its users and the public.

The Contributor, and not Gorilla Leak, will be fully responsible for all Posts Content or Contributor Content that is uploaded, posted, transmitted or otherwise made available by the Contributor on the Website (collectively "User Content"). Gorilla Leak cannot guarantee the accuracy, integrity or quality of User Content. Gorilla Leak does not pre-screen User Content, but will have the right (but not the obligation) in its sole discretion to refuse or remove any User Content for any reason, including User Content that may violate these Terms, or that is otherwise objectionable. Gorilla Leak also cannot take responsibility for anything that Your Posts users may do in reliance on the Posts Content You post in Your Posts.

7. TRADEMARKS AND SERVICE MARKS

"Gorilla Leak” service marks or trademarks may be protected by applicable laws. Other product and company names mentioned on the Website may be the trademarks of their respective owners.

8. LINKS TO THIRD PARTY WEBSITES

Your Posts and the Website may include links to other sites or resources over which Gorilla Leak has no control or responsibility. Gorilla Leak does not monitor, investigate or check these sites for accuracy or completeness. As a result, Gorilla Leak is not responsible for the content or advertising on such sites, products or other materials which they may provide, such sites’ availability, or any damages caused or alleged to be caused in connection with such external websites. All such external websites included as links in Your Posts or accessed by You via the Website is done at Your own risk and with Your own liability.

Gorilla Leak may provide pre-built modules that make it easy for You to find and add links to various sites. However, just because Gorilla Leak provides these modules does not mean Gorilla Leak is responsible for their accuracy. The Contributor is still responsible for what links he or she elects to put in his or her Posts or Contributor Content.

9. EARNING MONEY THROUGH GORILLA LEAK EARNINGS PROGRAM.

 

Gorilla Leak Earnings Program.

You may elect to participate in the Gorilla Leak Earnings Program. Contributors may earn a flat monthly amount, indicated via email communication to you.

By electing to participate in the Gorilla Leak Earnings Program, you acknowledge and agree to the following:

  • Your approval and acceptance into the Gorilla Leak Earnings Program is at Gorilla Leak’ sole discretion
  • Gorilla Leak may suspend or remove the Gorilla Leak Earnings Program or any part thereof (including Your participation in it) at any time, in Gorilla Leak’ sole discretion
  • Your election to participate in the Gorilla Leak Earnings Program may result in additional advertisements being placed on Your Posts
  • Advertisements from the Gorilla Leak Earnings Program will appear on Your Posts at Gorilla Leak’ discretion (and such advertisements may appear on every page load of your Posts)
  • The third-party advertising, referral, and/or other revenue providers in the Gorilla Leak Earnings Program will be determined at Gorilla Leak’ sole discretion.
  • The Gorilla Leak Earnings Program is not a revenue sharing program and the fee earned by a Contributor is determined solely by Gorilla Leak and will be based on Contributor meeting the quality and minimum daily posting schedule standards set by Gorilla Leak. Your ability to meet these standards will be determined solely by Gorilla Leak and may alter or terminate your role or payment and user account with Gorilla Leak.
  • The type, style, placement, and any other implementation decisions regarding how, when, and where ads in the Gorilla Leak Earnings Program are placed on Your Posts will be determined at Gorilla Leak’ sole discretion.
  • Gorilla Leak Earnings Program may place unpaid public-service, charitable, and/or default/placeholder ads on Your Posts
  • You will not engage in any fraudulent or deceptive practices with respect to the use of Gorilla Leak Earnings Program
  • Gorilla Leak makes no guarantee that the Gorilla Leak Earnings Program will be operational at all times
  • You may not transfer or assign Your Gorilla Leak Earnings Program account to any other person and/or entity

Payment.

As consideration for your participation in Gorilla Leak Earnings Program, You shall receive a payment indicated via email communication, pending your having met quality, posting and impression requirements. Your start date will determine whether your receive the full amount, half or a fraction of the amount for that month. For example, if you start on the 15th, you will receive half of the communicated monthly payment. If you start 3 weeks into the month, you may receive a quarter of the payment. Likewise, if you only submit half of the required content posts for the month, you will receive half the payment and your account may be subject to termination. For the avoidance of doubt, payments to You for Your participation in the Gorilla Leak Earnings Program will be made to you by Directors Live, through PayPal only. You acknowledge and agree that Gorilla Leak may change your payment amount with You at any time, communicated with you via email, at Gorilla Leak’ sole discretion.

The final determination of Your Earned Balance and payment amount to You for use of the Gorilla Leak Earnings Program on Your Posts will be made by Gorilla Leak in its sole discretion. Payment shall be calculated and based on records maintained by Gorilla Leak. No other data or statistics shall be accepted by Gorilla Leak or have any effect with respect to the Gorilla Leak Earnings Program.

Payments to You shall be sent by Directors Live, as the parent company of Gorilla Leak, within approximately Thirty (30) days after the end of each calendar month that you participated in the Gorilla Leak Earnings Program. For the avoidance of doubt, payments may be delayed and/or withheld (among other reasons) to the extent that Gorilla Leak has a delay in processing applicable reports, crediting Your account, and/or has yet to receive applicable funds from a third-party advertisers who participate in the program.

You acknowledge and agree that You will not publicly disclose Your payments from the Gorilla Leak Earnings Program without prior written consent of Gorilla Leak.

INDEPENDENT CONTRACTOR AGREEMENT

All bloggers, writers, experts & editors (referred to as contributors) are independent contractors and shall not be subject to the direction, control, or supervision of DirectorsLive.com regarding time accountability or procedures followed in performing services hereunder. DirectorsLive.com will be, however, the final decision maker in regard to the content and reserves the right to moderate, request changes and/or modify the content to ensure, among other things, that it complies with quality standards. All contributors are responsible for all tax liabilities derived from their payments. Contributors are not eligible for any benefits from DirectorsLive.com and waive any right to them.

Please note: compensation earned by a contributor is not comparable to compensation provided to another contributor, regardless of meeting minimum expectations. DirectorsLive.com offers a payment scale as a means of sharing information with contributors the potential compensation that they may earn, not a guarantee. DirectorsLive.com reserves the right to terminate or change a contributor’s participation in our earnings program at any time for any reason.

Fraud, Other Invalid Activity, and Breach.

Gorilla Leak reserves the right to withhold payment from You if You have, directly or indirectly, engaged in activity that is deceptive or fraudulent in nature, as determined by Gorilla Leak in its sole discretion. Notwithstanding anything to the contrary, Gorilla Leak shall not be liable for any payment from the use of Gorilla Leak Earnings Program based on: (a) any fraudulent or deceptive activities; (b) invalid activities generated by any person or automated means; (c) requests for end users to click on advertisements on Your Posts or repeatedly reload Your Posts to generate additional page impressions.

Any breach by You of this Agreement shall result in the permanent forfeiture of any Earned Balances for the applicable period. Notwithstanding any other remedies that Gorilla Leak may elect to pursue, such breach may result in a charge-back and/or future withholding for Your account, and you agree that Gorilla Leak may seek any such amounts from you in any manner permitted by law.

Account Information.

With respect to Your use of the Gorilla Leak Earnings Program, in order to ensure payment, You agree to provide and maintain accurate information associated with Your account, including: name, address, additional contact information (as may be requested), payment account information, tax information, and any other information (as reasonably requested by Gorilla Leak). You acknowledge and agree that it is Your sole responsibility to provide Gorilla Leak with accurate and sufficient information (as deemed by Gorilla Leak in its sole discretion) such that Gorilla Leak may make payments to You. Gorilla Leak may not be able to make payment to You, and may withhold payment, because of any (or combination) of the following reasons, including but not limited to: You have submitted inaccurate, partial, or insufficient payment information; You have submitted inaccurate, partial, or insufficient tax information; Gorilla Leak has been unable to reach You after contacting the address listed in Your account; the selected payment organization has rejected and/or returned payment to Gorilla Leak; You have not logged into Your account to provide all necessary information for the Gorilla Leak Earnings Program.

Taxes.

By participating in the Gorilla Leak Earnings Program, You assume sole responsibility for any taxes owed, and You agree to pay all applicable taxes or charges imposed by any government entity in connection with Your participation. You are solely responsible to provide all required tax information to Gorilla Leak. If You are a United States taxpayer, this includes but is not limited to: a) a valid United States tax identification number, and b) a completed Form W-9. If You are a non-United States taxpayer, this includes but is not limited to: a) a signed certification by You that You do not have activities in the United States, b) a completed Form W-8, or c) any other forms required by the United States tax authorities. Forms completed by non-United States taxpayers may require a valid United States tax identification number. You acknowledge and agree that for tax-related purposes Gorilla Leak may be required to make withholdings of payment amounts due to you.

Payment Mechanism and Uncollected Payments.

Gorilla Leak in its sole discretion will determine the approved payment mechanism(s) for You to receive payments due from Your running the Gorilla Leak Earnings Program. Your participation in the Gorilla Leak Earnings Program may be suspended or approval withheld until Gorilla Leak can validate that You have a valid account with approved payment mechanism. Payment mechanisms may be edited, added, or removed at any time, in Gorilla Leak sole discretion. The current payment mechanism for the Gorilla Leak Earnings Program is PayPal3. You must provide all necessary information (to both Gorilla Leak and any applicable third-parties) for Gorilla Leak to process payments to You.

Account Closure and Inactivity.

In the event that the Agreement is terminated by Gorilla Leak and/or Gorilla Leak elects to cease Your participation in the Gorilla Leak Earnings Program, then except in the event of breach by You, Gorilla Leak will make payment of an Earned Balance in Your account that is greater than Fifty Dollars ($50) within approximately ninety (90) days after the end of the calendar month in which the Gorilla Leak Earnings Program has stopped running. Any Earned Balance lesser than this payment threshold will be permanently forfeit by You (and You hereby waive any claim relating to the dispute of such payment and disclaim any and all interest in such funds).

In the event that the Agreement is terminated by You (pursuant to Gorilla Leak’ receipt of Your written termination notice) the entire amount of an Earned Balance in Your account will be permanently forfeit by You (and You hereby waive any claim relating to the dispute of such payment and disclaim any and all interest in such funds).

In the event You elect to not participate in the Gorilla Leak Earnings Program, but not terminate this Agreement, Gorilla Leak will make payment of an Earned Balance in Your account that is greater than Fifty Dollars ($50) within approximately ninety (90) days after the end of the calendar month in which the Gorilla Leak Earnings Program has stopped running.

In the event of Inactivity, the entire amount of an Earned Balance in Your account will be permanently forfeit by You (and You hereby waive any claim relating to the dispute of such payment and disclaim any and all interest in such funds). "Inactivity" means that any of the following have occurred:

a) There has been no change to Your Earned Balance for a period of greater than six (6) months;

b) Your account has expired tax information that is greater than six (6) months beyond the date of such expiration;

d) You have not responded to attempts to contact You at the primary email address listed in the contact information in Your account for a period of six (6) months from the date of the first attempt to contact You for which no response has been received.

General

Gorilla Leak reserves the right to modify the this agreement and/or Gorilla Leak Earnings program, at any time in its sole discretion. If Gorilla Leak changes any significant terms of the Impressions program and/or Gorilla Leak Earnings Program, Gorilla Leak will notify You by email and/or site notification, if reasonably practicable, at least two weeks before any such change occurs. At that point, You will have the option of opting out of the Gorilla Leak Earnings Program.

YOU UNDERSTAND AND ACKNOWLEDGE THAT THERE IS NO GUARANTEE THAT ANY MINIMUM LEVEL OF REVENUE, OR ANY REVENUE, WILL BE GENERATED AS A RESULT OF USING THE GORILLA LEAK EARNINGS PROGRMA.

10. DISCLOSURE OF MATERIAL CONNECTION

(a) Gorilla Leak may have a marketing or affiliate connection to products or services linked-to or otherwise made available on the Website. Through the use of advertising, marketing or affiliate links contained on the Website, Gorilla Leak may collect fees from transactions conducted or purchases made. Gorilla Leak makes this disclosure in accordance with the Federal Trade Commission’s 16 CFR, Part 255: "Guides Concerning the Use of Endorsements and Testimonials in Advertising."

(b) If You endorse any products or services on the Website for which there is a connection that might materially affect the weight or credibility of the endorsement (i.e., the connection is not reasonably expected by the audience), You must fully disclose the connection. For additional information, please review 16 CFR, Part 255 "Guides Concerning the Use of Endorsements and Testimonials in Advertising."

11. PRIVACY POLICY

We care about the privacy of our Users. By using the Website, you are consenting to have your personally identifiable information and aggregate data collected, used, and disclosed as set forth in our Privacy Policy (http://Gorilla Leak.com/help/privacy_policy), and to have your personally identifiable information transferred to and processed in the United States.

12. INDEMNIFICATION

You agree to indemnify, defend and hold Gorilla Leak and its partners, agents, officers, directors, employees, subcontractors, successors, assigns, third party suppliers of information, attorneys, advertisers and affiliates harmless from any liability, loss, claim and expense, including reasonable attorney’s fees, related to your violation of these Terms or use of the Website.

13. DISCLAIMER

THE SERVICE ARE PROVIDED "AS IS", "AS AVAILABLE", WITH "ALL FAULTS", AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE HEREBY DISCLAIMED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE MAY CONTAIN BUGS, ERRORS, PROBLEMS OR OTHER LIMITATIONS. GORILLA LEAK MAKES NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, OR THAT ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ANY CONTENT DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DOWNLOADED AT YOUR OWN RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM SUCH DOWNLOAD OR YOUR USE OF THE SERVICE..

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU EXPRESSLY UNDERSTAND AND AGREE THAT GORILLA LEAK WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE, UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR POSTS, CONTENT TRANSMISSIONS OR DATA, STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE, OR ANY OTHER MATTER RELATING TO THE SERVICE. GORILLA LEAK ALSO WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM YOUR FAILURE TO COMPLY WITH THE PROVISIONS OF THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GORILLA LEAK ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO OR USE OF OUR SERVICE; (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN; (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY; (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE; AND/OR (VII) USER CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY. IN NO EVENT SHALL GORILLA LEAK, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE TO YOU FOR ANY CLAIMS, PROCEEDINGS, LIABILITIES, OBLIGATIONS, DAMAGES, LOSSES OR COSTS IN AN AMOUNT EXCEEDING THE AMOUNT YOU PAID TO GORILLA LEAK HEREUNDER.

THIS LIMITATION OF LIABILITY SECTION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF GORILLA LEAK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

THE RELEASES HEREUNDER ARE INTENDED TO APPLY TO ALL CLAIMS NOT NOW KNOWN OR SUSPECTED TO EXIST WITH THE INTENT OF WAIVING THE EFFECT OF CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR," ASWELL AS OTHER LAWS REQUIRING PRESENT INTENT TO RELEASE FUTURE UNKNOWN CLAIMS.

These Terms, together with the Gorilla Leak Privacy Policy and any other agreements incorporated by reference in these Terms or entered into between You and Gorilla Leak in connection with Your registration as a Contributor, constitute the entire agreement between You and Gorilla Leak and govern Your use of the Website, superseding any prior agreements between You and Gorilla Leak. You also may be subject to additional terms and conditions that may apply when You use affiliate or other Gorilla Leak services third-party content or third-party software.

20. WAIVER

The failure of Gorilla Leak to exercise or enforce any right or provision of the Terms will not constitute a waiver of such right or provision.

21. ASSIGNMENT

23. DISPUTE RESOLUTION

If a dispute arises during your use of the Website or under these Terms, You agree to abide by the following dispute resolution process, only proceeding to the next step if the previous step has not resolved the issue satisfactorily.

2. Send an email to Gorilla Leak at: team@GorillaLeak.com describing the nature of the issue.

For any claim related to a payment under the Gorilla Leak Earnings Program, You must notify Gorilla Leak in writing within thirty (30) days of such payment. By failing to notify Gorilla Leak within such timeframe, You hereby waive any and all claims relating to any such disputed payment.

For any claim (excluding claims for injunctive or other equitable relief) arising in whole or in part from the Website or these Terms where the total amount of the award sought is less than $10,000, the party requesting relief may elect to resolve the dispute through binding non-appearance-based arbitration. The party electing such arbitration shall initiate the arbitration through an established alternative dispute resolution ("ADR") provider mutually agreed upon by the parties. The ADR provider and the parties must comply with the following rules: a) the arbitration shall be conducted by telephone, online and/or be solely based on written submissions, as selected by the party initiating the arbitration; b) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and c) any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. You agree that all other claims arising in whole or in part from the Website or these Terms shall be decided exclusively by a court of competent jurisdiction located in Arizona.
